Prison Officer Was Convicted of Sexual Assault And Sentenced To 10 Years in Jail

TAWAU – A prison officer was sentenced to 10 years’ jail and six strokes of the rotan after being found guilty of sexually assaulting a teenage girl last year.

Sessions judge Awang Kerisnada Awang Mahmud delivered the sentence against Marino Majabin, 48, after finding that the defense had failed to raise any reasonable doubt in the case.

Reading out his judgment, Awang said the court took into account the facts on the impact of the trauma on the victim and the public interest in reaching its decision.

He said the accused had taken the opportunity to commit two sexual acts on the 15-year-old victim, who came for treatment in the prison quarters on Jan 12, 2021.

Marino had been charged under Section 14(a) of the Sexual Offences Against Children Act 2017 which provides for a maximum jail term of 20 years and whipping.

According to the facts of the case, the victim and her father had gone to the accused’s house for alternative treatment.

Her father is Marino’s colleague.

Earlier, deputy public prosecutor Mohd Suhaimi Suriana had applied for a heavy sentence.

However, the accused’s counsel Ag Amli Noraufe Ag Nohin applied to the court to postpone the execution of the sentence to file an appeal to the High Court.
